FBI launches probe into ACORN over voter registrations

Greg Gordon
McClatchy Newspapers

WASHINGTON — A day after John McCain charged that the liberal-leaning voter registration group ACORN "may be perpetrating one of the greatest frauds in voter history,'' it was disclosed Thursday that the FBI is investigating whether the group coordinated the filing of phony applications.

Details of the inquiry weren't readily available. McClatchy confirmed an Associated Press report disclosing the investigation and learned that the FBI was attempting to determine if ACORN systematically encouraged the creation of fake voter registrations in several states.

Executive Director Michael Slater of Project Vote, which funds ACORN and represents it in legal matters, said the group has yet to be informed of any national investigation but would cooperate. Slater said that any suggestion that ACORN was orchestrating voter fraud was "absolutely false."

For years, ACORN has been a force in registering mostly younger, lower-income minorities to vote. So far this year, the group has registered 1.3 million new voters.

Because those new voters often support Democrats, Republicans have targeted ACORN and accused organizers of trying to undermine elections. Under former Attorney General Alberto Gonzales, U.S. attorneys were encouraged to bring voter-fraud cases, mostly against Democrats, and some prosecutors who balked were fired.

Project Vote's Slater said the timing of the investigation was "highly suspicious" because it was so close to the election.

"We knew this was coming," Slater told McClatchy. "We saw in 2004 that we were attacked by Republican interests, and law enforcement was politicized to go after us. We saw civil suits and organizations created whose specific purpose was to demonize ACORN."

According to Slater, ACORN has alerted authorities on a daily basis since late last year whenever internal reviews found that canvassers had submitted suspicious application forms.

Slater said that 1,187 packages, each containing a registration worker's daily collection of as many as 18 forms, have been flagged for county election officials as "potentially bogus." He also estimated that about 1 percent of ACORN's nationwide registration applications — some 13,000 forms — could contain fictitious names or addresses. In addition, as many as 25 percent may be duplicates.

County officials review each registration application and reject all duplicates. To affect an election tally, someone would have to vote in the name of the fictitious registrant, which is a felony.

ACORN officials said that most phony submissions came from canvassers who were trying to get paid without actually finding citizens who wanted to register to vote. They simply filled out the forms using names from the phone book, fictitious names or, in one case, "Mickey Mouse."

ACORN is bound by laws in most of the 21 states where it's been active to turn in all new registration applications, even suspicious ones, and the group follows that policy everywhere, spokesman Scott Levenson said.

Law-enforcement agencies in 11 states have been investigating former ACORN canvassers — investigations that have involved the FBI in Nevada and New Mexico.

During Wednesday night's final presidential campaign debate, McCain pressed Democratic rival Barack Obama to explain his ties to ACORN, which he said "may be destroying the fabric of democracy."

Earlier, Republican Sen. George Voinovich of Ohio sent a letter asking Attorney General Michael Mukasey to order an investigation of whether ACORN was committing voter registration fraud in an organized way.

The Ohio Republican Party is in a court battle with Democratic Secretary of State Jennifer Brunner over potential election fraud. The Republicans won a federal appeals court order demanding that Brunner turn over to county election officials by Friday the names of about 200,000 new registrants whose personal information did not exactly match state drivers' license or Social Security data.

Any discrepancies, no matter how small, could be used to challenge the eligibility of those Ohioans to vote.

Brunner filed an emergency appeal to the Supreme Court.

ACORN: We're patriots, not frauds

Collecting more than 1.3 million voter registration applications ought to be applauded. So why does John McCain paint us as a threat to democracy?

» Discuss Article

More than 1.3 million voter registration applications: That's how many low-income people, persons of color and young people ACORN has helped register this election cycle, including almost 40,000 here in California. In a country in which one-third of the eligible voting-age population -- heavily concentrated in minority communities, urban areas and among young people -- is not registered, such a deeply patriotic act should be celebrated.

Instead, ACORN, or the Assn. of Community Organizations for Reform Now, has been subjected to an unrelenting torrent of partisan attacks on the integrity of our voter registration effort, including the charge from John McCain that ACORN "may be destroying the fabric of democracy." In an editorial discussing our work on low-cost housing, The Times referred to ACORN's voter registration drive as "fraud-tolerant."

Let's look at some key facts about ACORN's national voter registration drive.

Fact: In most states, ACORN was required by law to submit every voter registration application it collects, regardless of the quality of each card.

Fact: ACORN conducts the most rigorous and sophisticated quality-control process for registering voters in the country. Each registration card is reviewed by three separate people; the registrants are then called as many as three times apiece to confirm the information on each card. In each state where we conducted voter registration efforts, ACORN submitted its cards to the agency that oversees elections twice a week in three batches: one of incomplete and spoiled cards, one of error-free cards and one of "suspicious" cards.

Fact: Out of ACORN's 1.3 million applications, 6.5% were incomplete or otherwise spoiled (about 65,000), 1.5% were in some way suspicious (about 19,500), and about 20% were duplicate registrations from people already on the voter registration rolls. These percentages are comparable to and in many cases better than those of other voter registration drives that have taken place this year.

Fact: ACORN pays its canvassers by the hour, not by the card; there is no rigid quota system. Like any employer, however, ACORN has standards to ensure that it is not paying for work that does not get done.

Fact: Some of ACORN's canvassers attempted to get paid for not doing their job by making up names or copying them from sources such as a phone book. When ACORN's quality control system caught them, the employees were fired and the suspicious cards were tagged and turned into the proper authorities. This constitutes fraud against ACORN, not fraud against the system. Over the course of the registration drive, ACORN fired 829 of its 13,000 canvassers for these and other quality-related issues.

Fact: Voter registration fraud is not voter fraud. Indeed, the fact that these cards were caught, generally by ACORN first, shows that the system works and operates with a high degree of integrity.

Why has ACORN suddenly become such a rallying cry for Republicans? The ultimate answer, of course, is to win the election. Partisan forces are unsettled by the large numbers of new voters ACORN is bringing into the system. Such rhetoric also seems to divert attention from one of the most unpatriotic activities we can imagine -- activities designed to suppress turnout through illegal purges of voter rolls, intimidation of voters at polling places, voter caging and similar tactics.

The highly charged rhetoric has had consequences. A torrent of hate mail and phone calls have poured into our offices, including death threats against our staff. Our Boston and Seattle offices were broken into last week.

The citizens ACORN has helped register this year are very real. Many of them will be coming out to vote today and in future elections. Far from being a threat, our work to encourage participation in democracy is deeply necessary for the reweaving of the fabric of our democracy. These voters should be welcomed to our democracy.

We at ACORN intend to be vigilant in our efforts to ensure that every single American who has a right to vote is allowed to exercise that right. ACORN will be out in our communities on election day, walking people to the polls and helping to make sure that everyone's vote is taken.

Martha Sanchez is chairwoman of the Los Angeles ACORN board of directors.

quote:

Types of conspiracies
  • Cabal, an association between religious, political, or tribal officials to further their own ends, usually by intrigue

  • Civil conspiracy (US), agreement between persons to break the law in the future

  • Conspiracy (crime) (US), agreement between persons to break the law in the future, in some cases having committed an act to further that agreement

  • Conspiracy (political), a plot to overthrow a government
